Environmental Information Regulations 2004 (EIR)

The new Environmental Information Regulations came into force on 1 January 2005. Environmental information is exempt from the Freedom of Information Act, and is released or withheld under the EIR.

What is Environmental Information?

Environmental information covers information on the state of the environment, such as:

  • air
  • water
  • soil
  • land
  • flora and fauna and diversity
  • genetically modified organisms
  • emissions and discharges
  • noise
  • energy
  • radiation
  • waste and other such substances
  • measures and activities such as policies, plans and agreements
  • reports
  • cost benefit 
  • economic analyses

Other area that may be affected by environmental factors will also be considered, these include:

  • the state of human health and safety
  • contamination of the food chain
  • ultural sites
  • built structures
