30 Aug 07Review of Premises Licence - Tesco Express, 184 Herbert Road
Borough of Poole’s Licensing Sub Committee met on Tuesday, August 28, to review the premises licence for Tesco Express, 184 Herbert Road, Poole.
The review was brought forward by the Weights and Measures Authority for the Borough of Poole after alcohol was sold to people under the age of 18 in test purchase operations on two occasions.
The store sold four cans of Budweiser lager to a 14-year-old female volunteer in July 2006 and sold four cans of Stella Artois lager to a 15-year-old male volunteer in December 2006.
The sub committee heard evidence from the Weights and Measures Authority and representatives of Tesco Stores Limited, the premises licence holder. The Weights and Measures Authority recognised the store had carried out training for staff since the two incidents in 2006 and was taking steps to prevent the sales of alcohol to people under the age of 18.
The sub committee concluded that the premises were not fulfilling the licensing objective of protecting children from harm. The following conditions were added to the existing licence conditions:
- The Designated Premises Supervisor or other Personal Licence Holders to be present on the premises to supervise all alcohol sales from 5pm to closing time (11pm) daily, except in exceptional circumstances such as staff/management illness or bereavement.
- All supervisors/duty managers and team leaders who are not personal licence holders to receive training through BIIAB
or equivalent body to Level 1 or its equivalent.
The conditions come into effect from October 29, 2007, they are to be maintained after this date if there is a change of staff.
Cllr Don Collier, Portfolio Holder for the Environment, said: “Borough of Poole takes underage sales very seriously. All licensed premises have an essential requirement to fulfil the licensing objectives of protecting children from harm. We will do all we can to assist premises in Poole with any additional training of their staff.”
Tesco Stores Limited has 21 days to appeal from the date they receive the decision.
