Dolphin Quays Development

An agreement has been negotiated by the Borough of Poole with the receivers regarding encroachments by the Dolphin Quays development onto Council owned land.

The encroachments, which were identified by the Council in the course of the development, occurred above and below the highway through overhanging balconies and foundations going under the Quay and Fisherman’s Road. Neither the foundations not the balcony space have any effect on the public being able to use the space.

In 2003/4 the Council investigated whether or not they were entitled to any payment in respect of these encroachment matters and approached the receiver who by then had been appointed after developers Poole Developments Ltd went into receivership.

After lengthy discussions, which included the help of a mediator, an agreement was reached whereby the council will lease to Poole Developments Ltd a narrow strip of land underneath the overhanging balconies for a peppercorn. The receiver has agreed to pay the Council a sum of £110,000 in compensation.
