A successful prosecution of a noisy neighbour is sending clear message to those causing noise nuisance in Poole.
As a result of complaints from neighbours and a thorough investigation by the Borough of Poole's Environmental & Consumer Protection Services, Ian Frampton of 147a, Alder Road was found guilty of causing statutory noise nuisance between 10 May and 13 August 2003.
Complaints related to noise created by Mr Frampton's repair, maintenance and improvement of a racing stock car carried out within 5 metres of a neighbouring residential property in Morrison Avenue.
In spite of a Noise Abatement Notice served in December 2002, residents continued to suffer noise nuisance. From May to August 2003, Council Officers witnessed several breaches of the notice which resulted in a summons being served on Mr Frampton in the Autumn of 2003.
Cllr Don Collier, Portfolio Holder for the Environment, said: "It's unfortunate that in this case the letters and calls about the level of complaints together with suggestions that work to the stock car be carried out away from people's homes were ignored. The protection of residents from unacceptable nuisance is a high priority and it's reassuring to see that the courts agreed with the action we took. The Council will continue to take a firm stand against those who deliberately or recklessly disturb their neighbourhood".
Shaun Robson, Head of Environmental & Consumer Protection Services, said: "This is an excellent result and supports the decision taken to pursue the matter and overcome the significant procedural barriers placed in our way. The case demonstrates the Council's tenacity to bringing persistent offenders to account".

After almost two years of legal arguments, the case was heard at Bournemouth Magistrates Court 20-23 June 2005. Mr Frampton was fined £1000 with £2000 costs.
