Dog Fouling Controls
Recent legislative changes have extended the types of land where local authorities can introduce local laws on dog fouling. A review of the existing dog fouling Order led by Poole's Environmental & Consumer Protection Service Unit has resulted in the introduction of a new dog fouling order by the Borough of Poole's Environment and Overview Committee on 28th June. The new Order comes into force on 20th July 2006.
A formal public legal notice summarising the new Order was published in The Echo on Friday 30 June 2006 (see below). The new Order states that it is an offence to leave dog faeces on any open land to which the public are permitted access in Poole Borough. The existing Order that expires on 20th July 2006 is restricted to land managed by The Borough of Poole apart from agricultural land or land that is mainly marshland, heathland or woodland.

NOTICE IS HEREBY GIVEN that on 28th June 2006 The Council of the Borough and County of the Town of Poole made the above order under Section 55(1) of The Clean Neighbourhoods and Environment Act 2005 (“the Act”) to the land described in the schedule below, being land to which the Act applies. The Order will come into force on 20th July 2006.
The effect of the Order is to make it an offence for a person in charge of a dog, to fail to clear up forthwith after the dog has defecated on any land described in the schedule below.
The Order is available for inspection and copies are available at Environmental & Consumer Protection Services, Unit 1, New Fields Business Park, Stinsford Road, Poole BH17 ONF.
SCHEDULE - LAND DESIGNATED BY DESCRIPTION
All land which is open to the air and to which the public are entitled or permitted to have access (with or without payment) within the Borough of Poole other than land which is placed at the disposal of the Forestry Commissioners under Section 39(1) of The Forestry Act 1967.
Any person committing a breach of the Order will be liable upon prosecution to such fine as is prescribed by Section 56(2) of the Clean Neighbourhoods and Environment Act 2005.
