Health & Safety Investigations

We have a shared working procedure across Dorset Local Authorities and the Health and Safety Executive (HSE) for investigating complaint and accidents.

Complaint Investigation

What happens after a health and safety workplace complaint is made to the Borough of Poole?

First, we will check that the complaint relates to a work activity where this Local Authority is responsible for enforcing the health and safety legislation. Then we will seek to identify from the information you provided:

  • who is responsible for health and safety at the location of the complaint?

  • who is at risk of injury or ill health or has no adequate welfare facilities?

  • what injury or ill health could result and how likely is this?

A complaints officer will assess your complaint and place it into one of the following categories:

  • Red = Serious Risk and an officer will follow it up.

  • Amber = Significant Risk and an officer will follow it up.

  • Green = Low Risk and it will not be followed-up.

What we will do

We may ask the employer to investigate your complaint or we may look into it ourselves. However, we may not be able to follow up your 'red' or 'amber' complaint if, from the information you provided, we are not able to identify or establish who is responsible for the work that you have complained about from the information you provided. 

The other situations where we may not investigate your complaint are:

  • when you make a complaint anonymously to us or withhold contact details. This is because we are not able to substantiate or discuss the information with you or ensure that it is not a malicious complaint.

  • when you have not raised the issue with the person responsible for health and safety or your trade union - unless, of course, you have good reason to believe you would be placed in a vulnerable position if you did raise your concerns with this person.

  • when there are no reasonably practicable precautions to deal with the matters that you raised.

  • when it is impracticable to pursue your complaint.

How will you know what has happened as a result of your complaint?

If you want feedback, we will contact you and let you know what we have done. 

If  we have assessed your complaint as low risk 'green' we will explain our decision.

Accident Investigation

We follow the Incident Selection Criteria which is used by Dorset Authorities and the HSE to help us determine which incidents to investigate.  You can find the protocol on the HSE website at the link below:

In the event that someone who has been injured as a result of a work related accident wishes to pursue a compensation claim their legal advisory may wish to obtain a factual statement from us.  Where we have investigated this will detail the investigation into their accident and the findings.  There is a charge for this service, please contact us for details.

Accidents at Work

Certain accidents occurring at work must be reported to the Health and Safety Executive.
